1. Acceptance of Terms & Marketplace Scope
These Terms and Conditions constitute a legally binding agreement between you (whether as a Commercial Driver, Commercial Fleet Owner / Transporter, or Cargo Shipper / Business) and Logistic Hub Nepal / Atithisewa Technology.
Logistic Hub Nepal operates purely as a digital technology marketplace connecting shippers with commercial fleet transporters and verified drivers for freight matchmaking, load bidding, route telemetry, and delivery coordination.
2. In-App Messenger & Permitted Communication Use
Dedicated Operational Scope: The in-app chat, calling, and messaging facility is provided exclusively for legitimate operational cargo transport, trip dispatch, loading dock instructions, and delivery verification between matched Drivers, Fleet Owners, and Shippers.
Prohibited Conduct: Users must not use in-app communication channels for:
- Harassment, abusive threats, defamation, or inappropriate language.
- Soliciting off-platform payments to circumvent marketplace platform fees or escrow safety.
- Transmitting fraudulent consignment documents, contraband solicitations, or unsolicited marketing (spam).
- Sharing deceptive identity credentials or false delivery confirmations.
3. Driver Road Safety & Distracted Driving Policy
Mandatory Motion Lockout Rule (>10 km/h):
Drivers are strictly prohibited from composing or reading messages while operating a motor vehicle. In compliance with road transport safety laws, the mobile application automatically disables chat typing inputs whenever the vehicle speed exceeds 10 km/h. Drivers must pull over and stop safely before responding.
4. Automated Screening & Content Security
Automated Security Analysis: Communications may be automatically analyzed for security, fraud prevention, safety violations, and platform policy enforcement.
Selective Moderation: Where potential violations are detected, messages may be reviewed using automated content-moderation technologies or authorized administrative review.
Tamper-Resistant Audit Logs: An immutable record of transactions, dispatch timestamps, and reported incidents is maintained to resolve freight condition and billing disputes.
5. Reporting Violations & Account Enforcement
One-Tap In-App Reporting & Blocking: Platform users can flag offensive messages and block counterparties immediately.
Account Sanctions: Repeated harassment, off-platform payment bypass, fraudulent cargo claims, or road safety violations may lead to formal warnings, temporary dispatch suspension, or permanent account termination.
6. Limitation of Liability & Governing Law
Logistic Hub Nepal is a digital connection technology marketplace and not a direct transport carrier or insurer. Physical consignment condition, loading safety, and driver road compliance remain under the direct control and legal responsibility of the contracting parties.
These terms are governed exclusively by the laws of Nepal. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Nepal.
